Terms of Use

This Agreement states the Terms and Conditions (“Terms of Use”) that govern your access and use of the on-line service available at JustTechJobs.com and its collection of technology-specific jobsites (collectively, the “Web Site”) to post and/or search for employment, resumes and/or job candidates, and manage the foregoing information with a set of online tools (collectively the “Services”) . The term "You" as used herein means the person (or the entity on whose behalf you are acting) who is agreeing to these Terms of Use.  The term “Company" as used herein means Jupitermedia Corporation, the owner and operator of the Web Site and Services.

Please read this page carefully as the Terms of Use are binding upon You. If you do not accept the Terms and Conditions stated here, do not use the Web Site or the Services. The Company may revise these Terms of Use at any time by updating this posting on the Web Site. You should visit this page periodically to review the Terms of Use which are binding on You.  A violation of these Terms of Use may result in termination of your use of the Web Site and Services as well as other legal remedies.

These Terms of Use include the Jupitermedia Corporation Privacy Policy and Web Site User Agreement, each of which is incorporated in its entirety into these Terms of Use by reference, to which You are indicating Your agreement and acceptance to be bound by the provisions thereof, by way of Your use of the Web Site.

 

You agree to pay all fees for your use of the Web Site and Services on a timely basis, where applicable, and no rights are granted under this Agreement until all payments are made in full.

 

Section 1. Eligibility.

You must be at least eighteen (18) years of age to access or use the Web Site and/or use the Services in any manner. Your access or use of the Web Site represents and warrants to the Company that You are at least 18 years of age, and that You have the right, authority and capacity to agree to and abide by these Terms of Use. You also represent and warrant to the Company that You will use the Web Site and/or the Services in accordance with all applicable laws and regulations.

 

Section 2. Acceptable Use of Web Site and Services.

(a) General. The Web Site and Services may be used only for lawful purposes by individuals seeking employment (“Candidates”) and persons or entities that are seeking candidates for employment (“Employers”). “User” as used herein refers to any individual and/or entity, whether Candidate, Employer or otherwise, accessing any aspect of this Web Site and Services for any reason. Guidelines for use of the Web Site and Services are set forth below, and acceptable use(s) shall be determined by the Company at its sole discretion.

(b) Use by Candidates.  The Company hereby grants You the non-exclusive, non-transferable right to access and use the Web Site and Services solely for use in seeking employment opportunities for yourself.   Pursuant to this grant, which the Company may suspend or terminate at any time for any reason at its sole discretion, You may (i) post to and save on the Web Site your resume, cover letter, profile, saved jobs, saved job searches, and other applicable information (collectively “Resume”), provided you are solely responsible for its content and any claims that may arise therefrom; and (ii) access Job Postings and copy or download from the Web Site a single copy of any Job Posting, as defined below, for your personal use. 

(c)  Use by Employers. The Company hereby grants You the non-exclusive, non-transferable right to access and use the Web Site solely for your internal business use in seeking Candidates for employment opportunities offered directly by You, or those of your business or company (“Job Postings”). Pursuant to this grant, which the Company may suspend or terminate at any time for any reason at its sole discretion, You may (i) post your Job Posting to the Web Site, provided you are solely responsible for its content and any claims that may arise therefrom; and (ii) access Resumes and copy or download from the Web Site a single copy of any Resume, as defined below, for your internal business use. 

(d)  Prohibited Uses. The Company specifically prohibits any use of the Web Site or Service for any of the following:

(i) Posting any incomplete, false or inaccurate information or information which is not Your own in your Job Posting or Resume. 


(ii) Posting non-employment related information such as opinions, or notices, commercial offerings or other information regarding the sale, transfer or assignment of any products or services, whether on a stand alone basis or contained within your Resume or Job Posting.

(iii)  Posting Resumes or Job Postings on behalf of others, except that headhunters, employment placement/outplacement agencies, temporary worker agencies, and other consultants may post Job Postings upon the express authorization of a third party whom they represent or assist in seeking Candidates to fill the third party’s employment opportunities.
 
(iv) Responding to or contacting any Employer for any reason other than to apply for a Job Posting, or to inquire further about the position with the bonafide intent to apply for it. Communications soliciting an Employer's business are prohibited.

(v) Responding to or contacting any Candidate for any reason other than to initiate further discussions with the Candidate about potential employment or the Candidate’s Resume. Communications by recruiters, search firms, or others soliciting Candidate(s) other than for potential employment opportunities are prohibited.

(vi) Posting a Job Posting that includes any franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement or other business opportunity which requires an upfront or periodic payment from, pays commissions only (without a significant salary) to, and/or requires recruitment of other members, sub-distributors or sub-agents by, Candidates.

(vii) Deleting or revising, or misappropriating as your own, any material posted on the Web Site by any other person or entity.

(viii) Posting a Resume, Job Posting or other material that violates any applicable law or regulation, or third party right, including but not limited to copyright, trademark, trade secret, patent, or other intellectual property rights, rights privacy or publicity.

(iv) Posting a Resume, Job Posting or other material that may be considered libelous, obscene, pornographic, threatening, abusive, hateful, or defamatory, at the Company’s sole discretion.

Section 3.  No Guarantee of Results.

You assume all responsibility and risk for your use of the Web Site and the Services, and your conduct on the Web Site including posting or accessing Resumes and/or Job Postings and communicating with other Users. 

The Company does not represent or guarantee the truthfulness, accuracy, or reliability of any Resumes, Job Postings, or communications posted by Users, or endorse any opinions or information expressed by Users. You acknowledge that any reliance on material posted by other Users will be at your own risk. You acknowledge and agree that You are solely responsible for the form, content and accuracy of any Resume or Job Posting placed by You on the Web Site.

The Company is not to be considered to be an employer with respect to the Web Site, and the Company shall not be responsible for any employment decisions, for whatever reason made by any Employer posting Job Postings on the Web Site. The Company makes no representations to any Candidate regarding the effectiveness of the Web Site or Services for your purposes.  The Company makes no guarantees to any Candidate that your use of the Web Site and Services will result in your finding employment of any sort, on a timely basis, and/or for any duration of time. Further, the Company shall not be responsible for any employment decisions, for whatever reason made.

The Company is not to be considered an employment agency or recruiter, and makes no representations to any Employer regarding the effectiveness of the Web Site or Services for your purposes. The Company makes no guarantees to any Employer that your use of the Web Site and Services will result in You finding suitable Candidates or employees, on a timely basis and/or for any duration of time.  

The Company is not responsible for screening or monitoring communications, Resumes, and Job Postings in advance. If notified by a User of material which violates the Terms of Use, the Company may investigate the allegation and determine in good faith and its sole discretion whether to remove the material. The Company has no liability or responsibility to Users for performance or nonperformance of such monitoring activities. The Company reserves the right to expel Users, terminate their User account, and prevent their further access to the Web Site for violating these Terms of Use or the law and the right to remove material which is abusive, illegal, disruptive, immoral, obscene, or defamatory in Company’s sole discretion.

Section 4. Registration, Password and User Information.

The Company may use and disclose the information it obtains as a result of your registration with the Web Site, including but not limited to your IP address, name, mailing address, and email address (“User Information”), (i) in connection with providing the Services to Candidates and Employers as the case may be, (ii) to the extent necessary to comply with applicable laws or as required by Court order where such information is relevant, and (iii) pursuant to the Company's Privacy Policy.

If You cancel your Web Site account, all your User Information, Resumes and Job Postings, will be removed from the Company’s databases and cannot be retrieved thereafter.

Your Web Site login and password may only be used by You to gain access to the Web Site and your User Information and may not be shared with others.  You are solely responsible for maintaining your Web Site login and password as confidential.  Upon becoming aware of any unauthorized use of your login and password, You shall immediately notify the Company of such.
